Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and Vitriv ("Vitriv", "we", "us", "our") and govern your use of the Vitriv mobile app, website, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time. Material changes will be notified via the app or by email at least 30 days before they take effect. Continued use after the effective date means you accept the update.

2. Who can use Vitriv

• You must be at least 16 years old to create an account.
• You must provide accurate registration information and keep it up to date.
• You are responsible for activity that happens under your account and for keeping your credentials secure.
• One person per account. Don't share login details or impersonate someone else.

3. What Vitriv does

Vitriv helps you track nutrition, plan meals, follow training programs, and tune your goals over time. The Service includes features like meal logging, a recipe library, AI-assisted meal planning and photo recognition, and progress tracking.

3.1 No subscription, AI is passthrough

Core features are free to use. AI features (meal planning, photo recognition, anything that calls a third-party model) are billed at cost as a passthrough. You'll see the price before you spend and can cap your usage in settings.

3.2 Changes to the Service

We may add, remove, or modify features. We'll give reasonable notice for material changes that meaningfully reduce functionality you rely on. Beta or experimental features may change or be withdrawn without notice.

4. Your content

You retain ownership of anything you submit to the Service — logged meals, photos, notes, custom recipes, progress entries ("Your Content"). You grant Vitriv a limited, worldwide, royalty-free license to store, process, transmit, and display Your Content solely to operate and improve the Service for you.

You are responsible for Your Content. Don't upload anything you don't have the right to share, anything unlawful, or anything that infringes another person's rights.

5. Acceptable use

When using the Service, you agree not to:

• Break the law or use the Service to harm others.
• Attempt to gain unauthorized access to any account, data, or system.
• Reverse engineer, decompile, or scrape the Service except where expressly permitted by law.
• Send spam, harass other users, or upload malware or harmful code.
• Use the Service or any AI feature to generate content that is illegal, harmful, defamatory, hateful, or sexually exploits minors.
• Resell, sublicense, or commercially redistribute the Service.

We may suspend or terminate accounts that violate these rules.

6. Health disclaimer

Vitriv is a tracking and planning tool. It is not a medical device. Nutritional information, calorie estimates, macro targets, meal suggestions, and exercise programs are for general informational purposes only and are not medical, nutritional, or fitness advice.

• Consult a qualified healthcare professional before starting any new nutrition or exercise program, especially if you are pregnant, nursing, under 18, or have a medical condition.
• Photo-based calorie and macro estimates are approximations. They may be wrong. Don't rely on them for clinical decisions.
• You assume all risk for the meals you eat, the workouts you perform, and the goals you set.

7. AI features

AI features generate suggestions using third-party models. By using them, you agree:

• Generated content (meal plans, recipes, macro estimates) may be inaccurate, incomplete, or unsuitable. Review before acting on it.
• Prompts and inputs (text, photos) are sent to our AI providers solely to fulfill your request. We do not allow them to train their models on your data.
• AI usage is billed at provider cost plus payment processing fees. We don't mark it up.

8. Payments

Where you purchase AI credits or any other paid feature, payment is processed by our payment provider. By purchasing, you authorize the charge against your chosen payment method. All sales are final unless required otherwise by applicable law. Refunds for unused AI credits are at our discretion within 30 days of purchase.

9. Intellectual property

The Service — including its code, design, logos, brand, and curated content — is owned by Vitriv and protected by intellectual property laws. These Terms do not grant you any right in the Service other than the limited right to use it.

If you send us feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free, irrevocable license to use that feedback without obligation to you.

10. Termination

You can delete your account at any time from the app, or by following the steps on our data deletion policy page.

We may suspend or terminate your account if you breach these Terms, abuse the Service, or if we're required to do so by law. Where reasonable, we'll let you know first.

On termination, your right to access the Service ends. Your data will be deleted in line with our Privacy Policy.

11. Warranties and disclaimers

The Service is provided "as is" and "as available" without any warranty, express or implied. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

We don't warrant that the Service will be uninterrupted, secure, error-free, or that calorie, macro, or training data will be accurate.

12. Limitation of liability

To the maximum extent permitted by law, Vitriv is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.

Vitriv's total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid to Vitriv in the 12 months before the claim or (b) USD 50.

13. Indemnification

You agree to indemnify and hold Vitriv harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of any law, or your infringement of any third party right.

14. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will first be raised informally by emailing [email protected]. If unresolved within 30 days, disputes will be referred to the exclusive jurisdiction of the courts of Hyderabad, India, subject to any non-waivable consumer rights you have in your country of residence.

15. General

• If any part of these Terms is held unenforceable, the rest remains in effect.
• Our failure to enforce a right is not a waiver of that right.
• You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• These Terms, together with the Privacy Policy, are the entire agreement between you and Vitriv regarding the Service.
